Fair Use Policy – Fastned UK Open Data API

This Fair Use Policy governs the access of Fastned’s Open Data API (hereafter, “the API”), designed to share reference and availability data about Fastned’s charge points and ad-hoc tariffs in the United Kingdom (hereafter, “the Data”) in accordance with The Public Charge Point Regulations 2023. By accessing the API you agree to adhere to this Fair Use Policy (hereafter, “the Policy”). 

 

  1. Acceptable Use

    1. Fastned grants You limited API access for the purpose of consuming the Data as described in the Public Charge Point Regulations 2023 pursuant to 4.2.

    2. You are prohibited from engaging in activities that may directly or indirectly harm, disrupt, or negatively impact the API, including but not limited to, malicious attacks, unauthorized access, or any form of abuse.

    3. You will not change the way the Fastned’s service functions. Fastned may throttle your use of the APIs at any time. Fastned may monitor your use of the APIs for compliance with these rules, and may at its sole discretion deny You access to the API if you violate this Policy.

 

  1. Security Measures

 

You are responsible for maintaining the confidentiality of your API keys and credentials. 

 

  1. Monitoring and Enforcement

    1. Fastned reserves the right to monitor and review the API usage patterns to ensure compliance with this Policy.

    2. Fastned reserves the right to implement rate limits on the API to ensure system performance, reliability, and overall service quality or for other reasons at its discretion.

    3. In case of any breach of this Policy or any applicable laws, Fastned may temporarily or permanently terminate your access and with no prior warning, reason or communication. 

 

  1. Ownership

    1. Fastned retains all rights, title and interest in both the Data and the API. Nothing in this Policy shall be interpreted as transferring any intellectual rights to you or any third party.

    2. Any use, adaption, exploitation, distribution, publishing, transmission or dissemination of the Data to any third party must at all times acknowledge the source of the Data as Fastned.

    3. Where the Data is adapted and exploited, distributed, published, transmitted or disseminated to a third party by You, You must acknowledge that Fastned’s source Data has been adapted.

    4. You will not misrepresent the Data at any time.

    5. Access to the API is provided solely under a limited, non-exclusive, non-transferable, and revocable license for permitted use as outlined in this Policy.

    6. Use of Fastned’s trademarks, logos, or branding in conjunction with the API or the Data requires prior written approval from Fastned. 

 

  1. Disclaimer

 

To the maximum extent permitted by law, Fastned provides the API and the Data as-is. That means Fastned does not provide warranties of any kind, either express or implied.

 

  1. Indemnification

 

You agree to indemnify in full and hold Fastned harmless from and against any and all claims, liabilities, damages, losses, costs, and expenses arising out of or in connection to your use of the API and/or the Data. 

 

  1. Limitation of liability

 

To the fullest extent permitted by law, Fastned shall not be liable for any indirect, incidental, consequential, or special damages arising out of or in connection with your use of the API and/or the Data. 

 

  1. Updates

 

We may update the API and this Policy from time to time by posting the changes on our website. 

 

  1. No Partnership

 

This Policy doesn’t create or imply any partnership, agency, or joint venture.

 

  1. Jurisdiction

 

This Agreement shall be governed by and construed in accordance with the laws of England and Wales and the English court shall have exclusive jurisdiction for all matters arising under it.
